Terms of Use
These Terms of Use govern your access to and use of 360, including our website, mobile applications, marketplace, payments, Smart Escrow, 360 Business, 360 Work, 360 Life and other services made available through the 360 platform.
By accessing, registering for or using 360, you agree to these Terms of Use and any policies referenced in them. If you do not agree, you should not use the platform.
1. Acceptance of Terms
These Terms form an agreement between you and 360 governing your use of the 360 platform and services.
By creating an account, accessing the platform, making a transaction or otherwise using 360, you confirm that you have read and accepted these Terms.
You must have the legal capacity required under applicable law to enter into transactions and use the services you select.
2. About 360
360 is a digital platform designed to help people connect, discover products and services, find work opportunities, manage businesses, communicate, transact and access useful tools.
The platform may include features such as:
- People, business and service discovery;
- Products and marketplace listings;
- Messaging and communication tools;
- Payment-enabled transactions;
- Smart Escrow;
- 360 Business tools;
- 360 Work opportunities and tools;
- 360 Life services;
- Creator and monetization features;
- Bureau De Change management software; and
- Other tools and services introduced by 360.
3. Accounts
Certain 360 features require you to create and maintain an account.
You are responsible for providing accurate information and keeping your account information current.
You are also responsible for maintaining the confidentiality of your login credentials and for activity performed through your account.
You must notify 360 promptly if you believe your account has been accessed without authorization.
You may not impersonate another person, create an account using misleading information or use another user's account without permission.
4. Marketplace Transactions
360 enables users, businesses and service providers to discover and transact with one another.
Unless specifically stated otherwise, 360 is not the seller, manufacturer, employer or provider of products and services listed by independent users.
Sellers and service providers are responsible for:
- Accurately describing their products and services;
- Providing agreed products or services;
- Setting lawful and accurate prices;
- Meeting applicable licensing requirements;
- Complying with consumer protection obligations; and
- Resolving issues relating to the quality or delivery of their offering.
Buyers are responsible for reviewing transaction details before making payment.
5. Payments, Charges and Fees
Some 360 services are free while others attract transaction fees, commissions, subscription charges or other disclosed charges.
Applicable 360 fees are displayed on our Pricing page or during the relevant transaction.
Payment processing
Payments may be processed through third-party payment providers, including Paystack.
Payment processors may charge their own processing, transfer, settlement or other applicable fees. These charges may be separate from 360's own fees.
You authorize 360 and its payment partners to process transaction amounts and applicable fees necessary to complete transactions you initiate.
6. Smart Escrow
Smart Escrow is designed to provide additional transaction protection by allowing funds to be held while the parties complete an agreed transaction.
Where Smart Escrow is used, release of funds may depend on confirmation of completion, transaction conditions, dispute handling procedures or other rules applicable to the transaction.
Users must not misuse escrow to facilitate unlawful, fraudulent or prohibited transactions.
7. 360 Business and Business Tools
360 may provide software and tools intended to help businesses manage operations, customers, products, services, transactions, visibility and monetization.
Businesses remain responsible for their own operations, accounting, taxes, regulatory compliance, licences and commercial decisions.
Bureau De Change tools
360 BDC provides business-management software for Bureau De Change operators.
Use of 360 BDC does not itself authorize a business to conduct foreign-exchange activities.
Each BDC operator is responsible for obtaining and maintaining all licences, approvals, registrations and regulatory compliance required for its operations.
8. Jobs, Gigs and Work Opportunities
360 may enable users to discover jobs, gigs, contracts, employers, clients and other work opportunities.
Unless expressly stated otherwise, 360 is not the employer, recruitment agency or contracting party for opportunities posted by independent users or businesses.
Users are responsible for evaluating opportunities, employers, workers and contractual arrangements before entering into agreements.
9. User Content
Users may be permitted to publish profiles, business information, products, services, images, videos, reviews, messages and other content.
You retain ownership of content you create, but you grant 360 a non-exclusive licence to host, display, reproduce and distribute that content as reasonably necessary to operate and promote the platform and your content within it.
You must have the right to upload or publish any content you submit.
360 may remove content that violates these Terms, applicable law or platform policies.
10. Acceptable Use
You must not use 360 to:
- Commit fraud or deceive other users;
- Sell illegal, stolen or prohibited goods;
- Facilitate unlawful transactions;
- Harass, threaten or abuse another person;
- Impersonate another person or business;
- Upload malicious software or harmful code;
- Attempt unauthorized access to accounts or systems;
- Manipulate reviews, ratings or platform activity;
- Abuse payment, escrow or refund systems;
- Violate intellectual-property rights; or
- Use the platform in violation of applicable law.
11. Third-Party Services
Some features of 360 rely on third-party services such as payment processors, communication providers, hosting services, app stores or other technology providers.
Those services may be governed by their own terms and policies.
360 is not responsible for outages, restrictions or failures caused solely by third-party systems outside our reasonable control.
12. Transaction Disputes
If a dispute arises between users, 360 may provide tools or processes intended to assist with resolving the transaction.
Where Smart Escrow is involved, the Escrow Policy and transaction records may be considered when determining whether funds should be released, refunded or remain on hold.
Users agree to provide accurate information and reasonable evidence where requested during a dispute.
13. Disclaimers and Limitation of Liability
360 provides a technology platform that helps users connect and transact. We do not guarantee that every user, listing, job opportunity, product or service will meet another user's expectations.
Users should exercise reasonable care when dealing with people they meet through the platform.
To the extent permitted by applicable law, 360 will not be liable for indirect, incidental, consequential or special losses arising solely from transactions between independent users.
Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.
14. Suspension and Termination
360 may restrict, suspend or terminate access to an account where we reasonably believe that:
- These Terms have been violated;
- The account is involved in fraud or unlawful activity;
- The account creates security or financial risk;
- Required verification cannot be completed; or
- Suspension is necessary to comply with law or a lawful request.
Where appropriate and legally permitted, we may give users an opportunity to address the issue.
15. Changes to the Platform or Terms
360 may introduce, modify or discontinue features as the platform develops.
We may also update these Terms from time to time. The latest version will be published on this page with an updated effective date.
Where a change is material, we may provide additional notice through the website, app, email or another reasonable communication channel.
16. Governing Law
These Terms are governed by the applicable laws of the Federal Republic of Nigeria.
Subject to any applicable dispute-resolution or consumer-protection requirements, disputes relating to these Terms may be submitted to courts with appropriate jurisdiction in Nigeria.
